Full Version: 'Trespassing' on a river

To be prosecuted for trespass the land owner has to prove intentional damage (I believe I'm right is saying?)

So how does 'trespass' apply to rivers where 'damage' is pretty much impossible?
There can be no trespass on rivers they belong to all of us, you can be however prosecuted for trespass crossing the land to get on and off a river if there is no access agreement in place.

Did you know that the EA normally owns 3' either side of a river?

Of course if we adopted the Scottish philosophy on access there would never be a problem in England or Wales!

there's about 4" to 6" of snow were I am & it's a real Xmas scene to boot.
